Changes in Availability of the Fraud Waiver

Prior to the enactment of the Immigration Reform Act of 1996, children could serve as qualifying relatives for parents who needed a waiver for having made misrepresentations or using false documents. The fraud waiver is now only available to applicants whose U.S. citizen or permanent resident spouse or parent would, if the waiver were denied, suffer extreme hardship.
